Lancelot Cigar Terms of Service

Welcome to Lancelot Cigar (hereinafter referred to as the "Platform"). The Platform is operated by its affiliated physical cigar lounge, Asia Pacific Cigar (Kuala Lumpur), and specializes in the online sale of Cuban cigars. By using the products and services provided by the Platform, you acknowledge that you have read, understood, and agreed to all contents of these Terms of Service (hereinafter referred to as the "Terms"), as well as the Platform’s published Privacy Policy, Order and Shipping Policy, and Return and Refund Policy (collectively referred to as the "Separate Policies"). In the event of any inconsistency between these Terms and the Separate Policies, or where these Terms do not cover certain matters, the Separate Policies shall prevail.
I. User Eligibility and Responsibilities

You confirm and warrant that you are at least 18 years of age (the legal minimum age for purchasing tobacco in Malaysia) and have full civil capacity when using the Platform’s services. The Platform will verify users’ age, and you shall actively cooperate and provide true and valid information. If you fail the age verification, the Platform reserves the right to refuse to provide services to you, cancel your order, and shall not be liable for any consequences thereof.

You undertake to purchase cigar products from the Platform solely for personal and legal use, and shall not use such products for resale, distribution, illegal trade, or other non-compliant purposes, nor shall you violate tobacco-related laws and regulations of Malaysia and your region (within the Asia-Pacific delivery scope). Any legal liability arising from your non-compliant use of the products shall be borne by you solely. The Platform reserves the right to terminate the provision of services to you and pursue your relevant liabilities.

You shall properly keep your Platform account, password, and other identity information. Any order losses or financial risks arising from the theft of your account or disclosure of your password shall be borne by you solely, and the Platform shall not be liable therefore. If you discover any abnormal account activity, you shall promptly notify the Platform and assist the Platform in taking corresponding measures.
II. Order and Payment Rules

By submitting an order on the Platform, you agree to purchase all products included in the order. Once submitted, order information (including product model, quantity, price, delivery address, etc.) cannot be arbitrarily revoked unless due to Platform reasons such as product stockouts or incorrect information. The Platform reserves the right to review order information; the order shall take effect formally upon approval. If the review fails (e.g., underage, delivery address outside the service scope), the Platform will cancel the order and refund all amounts you have paid.

Payment Method: The Platform supports third-party payment channels (subject to the display on the Platform). You shall complete the payment operation as prompted by the Platform. Upon successful payment, the Platform will confirm the order and arrange subsequent delivery. In case of payment failure or delayed crediting due to third-party payment channel malfunctions or your own payment operation errors, the order will not take effect, and the Platform shall not be liable therefore. You may contact the third-party payment channel or Platform customer service for resolution.

Price Description: All product prices on the Platform are subject to the display on the page. Prices may be adjusted due to market fluctuations, promotional activities, and other factors; such adjustments shall not affect the prices of already effective orders. Product prices do not include tariffs, import duties, and other relevant fees in various Asia-Pacific regions, which shall be borne by you solely. The specific standards shall be subject to the relevant laws, regulations, and customs requirements of your region.

III. Delivery and In-Store Pickup Services

The Platform will entrust cooperative logistics institutions to complete product delivery. Delivery timelines vary depending on the distance of your region, customs clearance speed, and other factors, and shall be subject to the Order and Shipping Policy.

Quality Assurance: For the storage, transportation, and quality assurance measures of cigar products, please refer to the Platform’s Order and Shipping Policy. The Platform will take reasonable measures such as moisturizing packaging to ensure product quality during transportation. However, the Platform shall not be liable for product damage, moisture, deterioration, or other issues caused by non-Platform reasons such as force majeure, non-compliant operations by logistics institutions, or abnormal climate in your region. You may contact the logistics institution or Platform customer service for assistance.

In-Store Pickup: The Platform is affiliated with the physical Asia Pacific Cigar (Kuala Lumpur) cigar lounge, and supports online ordering and in-store pickup services. You may select "In-Store Pickup" when submitting an order and confirm the pickup time and location (Asia Pacific Cigar Kuala Lumpur Store). After the order takes effect and payment is successful, you may present your order number and valid personal ID to pick up the product at the store within the agreed time. If you fail to pick up the product within the agreed time, the Platform reserves the right to cancel the order and handle it in accordance with the relevant rules of the Order and Shipping Policy. Upon pickup, you shall inspect the product quality on the spot and sign for acceptance; signing for acceptance shall be deemed as confirmation that the product has no quality issues.
IV. Return and Refund Policy
Cigars are special tobacco products, and their return and refund rules shall be strictly implemented in accordance with the Platform’s Return and Refund Policy. Please inspect the product quality promptly upon receipt (or in-store pickup and signature). If you find any quality issues such as mold or damage, you may apply for return, refund, and relevant compensation in accordance with the requirements of the Return and Refund Policy. Products without quality issues are not eligible for return or refund.
V. Privacy Protection
The Platform will strictly protect your personal information (including name, contact information, delivery address, payment information, etc.). The collection, use, storage, disclosure, and other handling of such information shall be conducted in accordance with the Platform’s Privacy Policy. The Platform will not arbitrarily disclose your personal information to third parties unless otherwise required by laws and regulations.
Please note that no method of internet transmission or electronic storage is 100% secure. Despite the above security measures taken by the Platform, the risk of data leakage cannot be completely eliminated.
VI. Intellectual Property Rights

All intellectual property rights owned by the Platform and its affiliated physical store Asia Pacific Cigar (Kuala Lumpur), including but not limited to the trademarks, logos, names of "Lancelot Cigar" and "Asia Pacific Cigar", Platform page design, product images, copywriting, layout, software programs, etc., are the property of Lancelot C World, Asia Pacific Cigar, or their licensors, and are protected by Malaysian intellectual property laws and international conventions. Without the Platform’s written permission, no entity or individual may arbitrarily copy, distribute, modify, use, reprint, or use them for other commercial purposes; otherwise, the Platform will pursue all legal liabilities against such acts.

The trademarks, brand logos, design appearances, and other relevant intellectual property rights involved in the Cuban cigar products sold by the Platform are owned by the corresponding cigar brand owners or legitimate obligees. The Platform only conducts sales based on legal authorization and does not own the ownership of such intellectual property rights. No user may arbitrarily use such intellectual property rights to engage in infringing activities. Any intellectual property disputes arising therefrom shall be borne by the user solely and shall be unrelated to the Platform. The Platform reserves the right to terminate services to relevant users and cooperate with obligees to pursue users’ liabilities.

You undertake that during the use of the Platform’s services, you shall not upload, publish, or disseminate any content infringing upon third parties’ intellectual property rights (including trademark rights, copyrights, patent rights, etc.), nor shall you use the Platform to engage in any intellectual property infringement activities (including but not limited to selling counterfeit and infringing cigar products, misappropriating others’ brand materials, etc.). If you violate the provisions of this clause, the Platform reserves the right to immediately delete relevant content, cancel orders, freeze accounts, and shall not be liable for any compensation. If losses are caused to the Platform or third parties, you shall fully compensate for such losses, and the Platform reserves the right to pursue your legal liabilities and cooperate with relevant authorities and obligees in rights protection efforts when necessary.

If you believe that the Platform’s content or other users’ acts infringe upon your intellectual property rights, you may submit a written complaint and relevant evidence (including proof of intellectual property ownership, proof of infringement, etc.) to us through the Platform’s customer service channel. The Platform will review the complaint promptly upon receipt. If infringement is verified, the Platform will immediately take necessary measures such as deletion, blocking, and de-linking, notify the relevant users, and cooperate with you in rights protection work.
VII. Disclaimer Clauses

The Platform shall not be liable for any order delays, cancellations, undeliverable products, or other issues caused by force majeure (including but not limited to earthquakes, typhoons, floods, wars, policy adjustments, customs control, etc.). The Platform will endeavor to assist you in handling relevant matters and refund the amounts you have paid (excluding incurred tariffs, taxes, and other fees).

Any delivery delays, product losses, failure to pick up, or other issues caused by incorrect or incomplete personal information (including delivery address, contact information, etc.) provided by you shall be borne by you solely, and the Platform shall not be liable for relevant compensation.

The Platform only provides online sales of Cuban cigars and related delivery and in-store pickup services, and shall not be liable for any health liabilities arising from your use of the products. You acknowledge the potential health impacts of cigar products and voluntarily purchase and use them.

The Platform shall not be directly liable for any losses caused by service malfunctions of third-party institutions (including but not limited to third-party payment channels, logistics institutions), and will assist you in contacting third-party institutions for resolution.
VIII. Dispute Resolution
The formation, performance, interpretation of these Terms, and dispute resolution shall be governed by the laws of Malaysia. Any dispute between you and the Platform arising from these Terms, Separate Policies, or Platform services shall first be resolved through friendly negotiation. If negotiation fails, either party may apply for arbitration to the relevant arbitration institution in Kuala Lumpur or file a lawsuit with the competent court in Kuala Lumpur.
IX. Miscellaneous Clauses

Lancelot Cigar Platform reserves the final right to interpret these Terms and the Platform’s Separate Policies. The Platform reserves the right to adjust and update these Terms and Separate Policies in accordance with laws and regulations. The adjusted contents will be published in a prominent position on the Platform page and shall take effect upon publication. Your continued use of the Platform’s services shall constitute your acceptance of the adjusted contents.

If you have any questions, suggestions, or complaints during the use of the Platform’s services, you may contact us through the Platform’s customer service channel, and we will handle them within a reasonable time.

These Terms shall take effect on the date you first use the Platform’s services. If you do not agree to any content of these Terms, you shall immediately stop using the Platform’s services.
